On Tuesday, the advocates for the President Barack Obama will appear in the court in order to save the cornerstone of his healthcare overhaul, while aiming to argue that the demand for insurance is lawful.

A jury constituting 3 judges of the U. S. Court of Appeals for the Fourth Circuit is established to consider the judgments of lower court, whether it was correct in striking down the requirement. Although the name of the panel judges will not be disclosed till Tuesday morning and the decision would not be considered as final as believed to reach the Supreme Court.

As per the legal experts, the case is critical as it will have oral arguments before an appeals court i. e. the verdict can influence the other courts at the same time will credit to be the first challenge to the law and to reach the high court.

A former Justice Department appellate lawyer, Kevin Russell, said: “It will also be important because any future decision from other courts will feel compelled to respond to the Fourth Circuit’s reasoning”.
